VIENNA CHARTER TOWNSHIP

RESOLUTION FOR THE ESTABLISHMENT OF FEES

PURSUANT TO THE MEDICAL MARIHUANA LICENSING ORDINANCE

At a regular meeting of the Township Board of the Charter Township of Vienna, Genesee County, Michigan, held on the 2nd day of May, 2011, at 5:30 p.m. Local Time.

Present: Belill, Scott, Luttenbacher, Ridley, Taylor, Zinn

Absent: Fuller

After discussion, the following resolution was offered in a motion by Luttenbacher, and supported by Scott;

WHEREAS, the Township Board of Vienna has enacted Ordinance No. 400 to regulate the growth, consumption, and distribution of Medical Marihuana within the Township pursuant to the Michigan Medical Marihuana Act, MCL 333.26421 et seq.; and

WHEREAS, the Township Board of Vienna Township wishes to establish the Application Fee, Annual Renewal Fee, and Quarterly Inspection Fee for Medical Marihuana Patient Care Centers located within the Township; and

WHEREAS, the Township Board of Vienna Township has determined that the amount of each fee must reflect the size of the Patient Care Center in terms of the number of Primary Caregivers and Registered Patients that are members of the Patient Care Center.

NOW, THEREFORE, BE IT RESOLVED by the Township Board of the Charter Township of Vienna, Genesee County, Michigan, approves the following schedule of fees for Patient Care Centers:

Application fee $100.00

Variance at the Zoning Board of Appeals $300.00

Special Land Use at the Planning Commission $200.00

Special Meeting for Public Hearing at the Township Board $400.00

License (yearly) $150.00

Quarterly Inspection Fee per Number of Primary Caregivers

1 Caregiver $ 50.00

2 - 5 $100.00

6 - 15 $200.00

16 - 25 $300.00

26 - 40 $400.00

41 & up $500.00
